General Conditions of Use

These General Conditions of Use (hereinafter referred to as the “General Conditions”) regulate use of the services offered by shop.idcdockworkers.org, which IDC (INTERNATIONAL DOCKWORKERS COUNCIL - CONSEJO INTERNACIONAL DE TRABAJADORES, hereinafter referred to as “IDC”) makes available to its users through its platform.

The registered address of IDC (INTERNATIONAL DOCKWORKERS COUNCIL - CONSEJO INTERNACIONAL DE TRABAJADORES) is located at C/Del Mar, 97. 08003 BARCELONA, holder of Spanish Tax ID Number (CIF) G62369053, on record at the Commercial Register of BARCELONA.

IDC (INTERNATIONAL DOCKWORKERS COUNCIL - CONSEJO INTERNACIONAL DE TRABAJADORES), as the company which provides the service consisting of the website shop.idcdockworkers.org, is governed by Spanish law and, in particular, by Act 34/2002, of July 11, 2002, the Information Society and Electronic Commerce Services Act.

No website which, as a service provider, allows the submission of users’ content in real time, by virtue of Act 34/2002, of July 11, 2002, the Information Society and Electronic Commerce Services Act, is responsible for the content stored at a user’s request, on the condition that the website has no effective knowledge thereof, “effective knowledge” being defined as a competent body declaring the content illegal and then officially notifying the service provider.

6. Industrial and Intellectual Property Rights

Likewise, those contents which are intellectual property of IDC or third parties may not be regarded as assigned to the User by virtue of the provisions of these General Conditions, nor may any of the rights of exploitation which exist or may come to exist for those contents, beyond that which is strictly necessary for the proper use of the services of shop.idcdockworkers.org. 7. Exclusion of Guarantees and Liability

To the full extent allowed by the legal system, IDC denies all responsibility for any damages or harm of any nature which may be caused by the lack of availability of continuity in the operation of shop.idcdockworkers.org and its services, or any disappointment over the website’s utility which the Users may attribute to shop.idcdockworkers.org or the services therein, or the reliability of shop.idcdockworkers.org and its services, in particular, though not on an exclusive basis, any failures in accessing the various web pages which make up shop.idcdockworkers.org.

7.2. Exclusion of guarantees and liability for the operation of software, in relation with the contents, possible existence of viruses and effectiveness or security measures.

IDC does not guarantee:

To the full extent permitted by the legal system, IDC denies all liability for any damage and harm of any type which may be caused by errors in the software or contents, or due to the presence of any virus which may cause disruptions in the User’s computer system, electronic documents or files.

IDC does not guarantee the legality, reliability or utility of the contents. To the full extent permitted by the legal system, IDC denies all liability for any damage and harm of any type which may be caused by the transmission, dissemination, storage, availability, receipt, obtaining of or access to the contents and, in particular, though in no way on an exclusive basis, for any damage or harm which may have been caused by:

  • Non-compliance with the Law, morals and generally accepted good customs or the public order, as a result of the transmission, dissemination, storage, availability, receipt, obtaining of or access to the contents.
  • The violation of intellectual and industrial property rights, business confidentiality, contractual commitments of any type, the rights to honor, personal and family privacy and the personal image of individuals, property rights and rights of any other nature belonging to a third party as a result of the transmission, dissemination, storage, availability, receipt, obtaining of or access to the contents.
  • The performance of acts of unfair competition and illegal advertising as a result of the transmission, dissemination, storage, availability, receipt, obtaining of or access to the contents.
  • The lack of truthfulness, accuracy, thoroughness, pertinence and/or currentness of the contents.
  • Inadequacy for any sort of purpose or disappointment in terms of the expectations generated by the contents.

IDC denies all responsibility for any damage or harm of any nature which may be caused by the presence of a virus or other damaging elements in the services provided by third parties through shop.idcdockworkers.org which may cause disruptions in the User’s computer system.

IDC does not guarantee the legality, reliability or utility of the services provided by third parties through shop.idcdockworkers.org. IDC denies all responsibility for any damage or harm of any nature which may be caused by the third-party services provided through shop.idcdockworkers.org.

7.4. Exclusion of guarantees and liability by IDC for the Users’ use of the services and contents.

IDC does not guarantee that the Users will use the services and contents of shop.idcdockworkers.org in accordance with these General Conditions or, where appropriate, with the Specific Conditions which may be applicable, or that they will do so in a diligent or prudent manner. Nor does IDC ensure the accuracy of the information which the Users provide about themselves in their profile, or directly to other Users. 8. Filing Complaints/Claims to IDC

9. Removal and Suspension of the Services

IDC podrá retirar o suspender en cualquier momento y sin necesidad de previo aviso la prestación de servicios, procediendo a cancelar la cuenta, de aquellos Usuarios que incumplan el establecido en las presentes Condiciones Generales.


11. Duration and Termination

In principle, IDC will be providing the services through shop.idcdockworkers.org for an indefinite time period. Nevertheless, IDC is authorized to terminate or suspend the rendering of its services at any time, regardless of that which is established in this respect within the corresponding Specific Conditions. In any case, if possible, IDC must attempt to give prior notice as to the termination or suspension of any service or all of them.


12. Personal Information Protection

  • 1. Information Rights

    In accordance with that the provisions of Spanish Public Act 15/1999, of December 13, 1999, on Personal Information Protection (hereinafter referred to as the “LOPD”), IDC, the owner of the website www.shop.idcdockworkers.org (hereinafter referred to as the “website”), hereby informs the Users of this site of the existence of an automated file containing personal information; said file was created by IDC, which is the party responsible for the file.

  • 2. Purpose

    The information of Users registered through the forms enabled for this purpose on the website is requested by IDC with the purpose of making it easier for IDC to provide the services which it renders on said website, and more specifically to provide access through the use of a user name and password, as well as distributing commercial information on services which may be of interest to Users.

  • 6. Users’ Rights of Access, Correction, Objection and Deletion.

    The Party Concerned is acknowledged the rights to access, correct, delete and object to information, rights which he or she may exercise as established in the current laws in force, by sending a request which must be sent by certified mail with acknowledgement of receipt to the following address:

    • An address for the purpose of sending notices
  • 7. Security

    IDC maintains personal information protection security levels in accordance with Royal Decree 1720/2007, of December 21, 2007, regarding security measures for automated files containing personal information, and has established all of the technical means within its reach to prevent the loss, misuse, disruption, unauthorized access and theft of the information which the User provides through the website, without prejudice to informing the User that security measures on the Internet are not invincible.

    IDC undertakes to fulfill its duty to maintain secrecy and confidentiality with respect to the personal information in the automated file in accordance with the applicable laws, as well as handling it in a secure manner whenever any assignments of information or data take place, where appropriate.

  • 8. Newsletter and Commercial Electronic Communications

    IDC may make available to those users who authorize doing so in advance by way of the subscription form for that purpose the service of sending a newsletter which includes news, current events and the most relevant information on the website. Likewise, the User may unsubscribe or modify the information in the subscription to the aforementioned newsletter using the interactive form included on the website.

    Similarly, IDC hereby informs you that it will be sending commercial communications using electronic means, with information on other products, services and events which may be of interest to the website’s users, when they expressly request to receive them. This consent may be revoked by the User at any time simply by sending notice of the wish to do so to IDC, though the effects shall not be retroactive.

  • 9. Applicable Legal System

    The General Conditions herein are governed by the laws of Spain. The interpretation and resolution of any conflict that may arise as a result of the User’s use of the services at shop.idcdockworkers.org shall be subject to the current laws in force in the Kingdom of Spain and the jurisdiction of the Courts and Tribunals of Barcelona, Spain.
